This regulation is necessary in order to properly implement and administer Ark. Code Ann.§27-16-903 and Ark. Code Ann.§27-23-101 et. seq.

APPLICATION FOR COMMERCIAL DRIVER'S LICENSE

  1. The Office of Driver Services shall cancel any application for a commercial driver's license or suspend any commercial driver's license for a minimum of sixty (60) days upon determining one or more of the following:

(a) any fraud by the driver in making application for the license;

(b) failure of the driver to give all required information on the application for the license;

(c) failure of the driver to submit correct information on the application;

(d) discovery that the driver is not eligible for license under Title 27 of Arkansas Code Annotated;

(e) failure of the driver to pay any required fees for licensing.

  1. The Office of Driver Services is to conduct any suspension under this regulation in the manner provided for in Ark. Code Ann.§27-16-907. Any licensee suspended under this regulation shall be entitled to a hearing as provided in Ark. Code Ann. §27-16-907.
